BOOKING TERMS AND CONDITIONS
IMPORTANT INFORMATION
By booking a program or service with NL First Aid, including online or via an authorized affiliate, customers acknowledge that they have read, fully understood and agree to comply with NL First Aid's Terms and Conditions & General Information.
RELEASE & WAIVER
Prior to any training, participants must sign a Release & Waiver Form declaring that they fully understand the requirements of the program and voluntarily assume all risks (For participants under the age of 16, a Parent/Guardian signature is required on the Release & Waiver).
CUSTOMER / REGISTERED PARTICIPANT
A Customer is the person (or Company) making a booking for a program or service for themselves and/or others and a Registered Participant is a person booked to take part in a program or to receive a service. A person may be both the Customer and the Registered Participant.
CONSENT
Knowledge and consent are required for the collection, use, or disclosure of Personal Information except where required or permitted by law. Providing us with your Personal Information is always your choice. However, your decision not to provide certain information may limit our ability to provide you with our products or services. We will not require you to consent to the collection, use, or disclosure of information as a condition for the supply of a product or service, except as required to be able to supply the product or service.
‘TO BE CONFIRMED’ (TBC) PARTICIPANT NAMES AND NAME CHANGES
Customers may book programs with participants’ names ‘To Be Confirmed’ (TBC) at any point up to the scheduled start time. A TBC booking is considered a full booking for billing, cancellation, rescheduling and ‘no-show’ purposes. A customer may change any participant registered by them on a program up to the scheduled start time without penalty.
PARTICIPANT DETAILS
For registration with the Canadian Red Cross and/or WorkplaceNL or Transport Canada, the minimum participant details required at the time of booking or prior to program commencement are:

Non-Marine Programs: First and Last Name, email address unique to the participant and Date of Birth

Marine Programs: As above, plus Mailing Address
PAYMENT / BILLING
Programs and services must be paid for in full to confirm a booking unless previously agreed to in writing by NL First Aid – i.e. company Purchase Order (PO) for invoicing. Issue of a PO or agreement in writing regarding invoicing is considered a full booking for billing, cancellation, rescheduling and ‘no-show’ purposes.
BOOKING CANCELLATION

BY THE CUSTOMER – PROGRAMS UP TO TWO (2) DAYS IN DURATION. If a booking is cancelled five (5) or less business days prior to course commencement, no refund is offered for pre-paid bookings and PO/Invoiced clients are required to pay the full fee, including private/non-scheduled courses. Bookings cancelled six (6) or more business days prior to commencement will be refunded.

BY THE CUSTOMER – PROGRAMS OVER TWO (2) DAYS IN DURATION. If a booking is cancelled ten (10) or less business days prior to course commencement, no refund is offered for pre-paid bookings and PO/Invoiced clients are required to pay the full fee, including private/non-scheduled courses. Bookings cancelled eleven (11) or more business days prior to commencement will be fully refunded.

BY NL FIRST AID. NL First Aid will not cancel a course – even if only a single booking is made - without full agreement with the customer(s), unless for reasons beyond its control. For any program cancelled with agreement, customers will be eligible for 100% refund or reschedule.

DELAY, POSTPONEMENT OR CANCELLATION DUE TO CIRCUMSTANCES BEYOND THE CONTROL OF NL FIRST AID, INCLUDING COVID-19 ALERT LEVEL OR OTHER PUBLIC EMERGENCY PROTOCOLS Customers of programs delayed, postponed or cancelled due to circumstances which are beyond the control of NL First Aid, i.e. Covid-19 Alert, Inclement weather, Public Emergency, etc are not eligible for a payment refund but customers will have the option of rescheduling to any program within 90 days of training recommencement or being cleared to continue.

DUE TO MEDICAL REASONS. If a participant cannot attend a program due to Medical Reasons, they may reschedule to an alternate program within 90 days* without penalty by providing NL First Aid with a verifiable physician’s certificate within 7 days of the original program starting date, stating the participant cannot or was unable to, take part due to medical reasons (details of the condition are not required). Rescheduling is not offered to participants who initially sign the Program Release & Waiver stating they have no medical or health concerns about participation then later in the program declare an existing condition which prevents them from or may be aggravated by participation.
NON-COMPLETION OF BLENDED LEARNING ONLINE TRAINING
Blended Learning courses require participants to complete a Knowledge Development program online prior to attending an in-class practical demonstration session. Attending a practical demonstration session prior to completing online training is not permitted per program standards and this is communicated to customers at the time of booking therefore non-completion of the online training is considered a cancellation by the customer and a re-booking is required to complete full training.
DUE TO 'NO SHOW'
‘No-Show’ is considered to be a cancellation of the program by the Customer per above and applies to the following:

a registered participant who arrives for training later than the scheduled start time or is late returning from a break on any day of a program, when training has already started.

a registered participant who fails to arrive on time for training on any day of a program. Should a registered participant not show for a class already in progress or fail to return in time from a break without approval by prior notification or contact with the instructor, they will not be permitted to complete the training and if they wish to attend a later program, no refund or reschedule will be offered and it must be re-booked.
Note: NL First Aid understands that there may be circumstances such as heavy traffic, inclement weather, etc which may affect punctuality so if a program is underway, latecomers may be permitted to participate at the instructor’s discretion but only if doing so will not inconvenience or negatively affect the program for other participants, all required content can still be covered and minimum training times can be met. In consideration of other participants who arrive on time for training, more than 15 minutes late for program start or 5 minutes late returning from a break is too late and is considered a ‘No-Show’. The instructor’s decision is final in such circumstances.
CATCH-UP SESSIONS
‘Catch-Up’ sessions for participants who miss portions of training due to being late back from a break, etc may be arranged but they are entirely at the discretion of the instructor and will incur a pre-paid fee of $75 + HST for the first hour or part thereof and an additional $25 per subsequent half-hour or part thereof.
RESCHEDULING - PROGRAMS UP TO TWO (2) DAYS IN DURATION
A booking up to two (2) days duration may be rescheduled to another date (subject to availability) without penalty up to five (5) business days prior to course commencement. Unless otherwise agreed to prior to booking or under a pre-existing client arrangement, a reschedule five (5) or less business days prior to course commencement will be charged as follows:

*For blended learning programs, rescheduling more than 6 weeks beyond completion of the online portion (4 weeks for Marine Basic First Aid) will require it to be completed again.
RESCHEDULING - PROGRAMS OVER TWO (2) DAYS IN DURATION
A booking over two (2) days duration may be rescheduled to another date (subject to availability) without penalty up to eleven (11) business days prior to course commencement. Unless otherwise agreed to prior to booking or under a pre-existing client arrangement, a reschedule ten (10) or less business days prior to course commencement will be charged as follows:

RE-BOOKING FEE
The re-booking fee for all cancelled courses, i.e. due to no-show, late arrival, etc is 75% of the original course fee, plus HST.
EXPENSES
If a customer is eligible for a refund or reschedule, NL First Aid will not reimburse customers for any expenses they may have incurred, such as travel or accommodation.
BUSINESS DAYS
For the purposes of cancellation or rescheduling times above, Business Days are considered to be Monday to Friday, with the exception of statutory holidays. Saturday, Sunday and any day Monday-Friday which is a statutory holiday are not considered business days, even if training programs are scheduled for those days.
PHYSICAL ACTIVITY & HEALTH INFORMATION
First Aid training activities aim to prepare individuals how to deal with emergency situations which may demand a degree of physical exertion and so may include lifting, bending and kneeling, using CPR mannequins, role playing/contact with staff and other participants and handling/using first aid related equipment. NL First Aid strives to ensure that all activities are completed safely, however given the practical hands-on type of training used it is important that people understand the risks associated with their current state of health. The physical requirements of the training activities should not pose a problem or hazard for most people but could be a problem for anyone who has sustained injuries in the past or who is currently suffering from an illness or injury, including but not limited to: Heart Condition, Chest Pains, High Blood Pressure, Fainting or Dizziness, Bone, Muscle or Joint Problems, Seizures, Asthma, Pregnancy, Recent Surgery.
If a person has (or is unsure about) any medical or health related concerns, is taking medications, has a medical condition, injury or illness or any existing or previous condition which could prevent participation in physical activity or which could be aggravated by it, they should seek advice from a physician prior to registering for a program. NL First Aid staff are not physicians and will not offer opinion or advice to anyone who is registered as to whether or not they should participate in a program if they have a medical or health concern. They will only advise consulting a physician.
For the safety and well-being of all participants and staff, a person who has been in contact with or is in the stages of any infectious condition at the time of the program should not participate and should reschedule.
Anyone with concerns about allergies should inform NL First Aid prior to program commencement.
For the safety of participants, NL First Aid reserves the right for the program instructor(s) to politely decline to commence or continue training for any person who appears to be ill or injured and to advise they seek physician clearance to continue at a later date or to call for advanced medical care depending on the circumstances.
INSTRUCTOR CONTACT
Unless otherwise published or notified to participants, NL First Aid program instructors are contactable via Telephone (709) 727 4120 or email training@nlfirstaid.com except when they are conducting programs. Telephone and email notifications are silenced 15 minutes after scheduled start time of a program until all participants have left the facility at the end of a training day.
TRAINING LOCATION
Unless notified to participants at the point of booking or by their training coordinators, programs will be held at the Relyon Nutec Canada training centre, 35 Beclin Rd, Mount Pearl, NL A1N 5G4.
If any training facility for a program is changed due to unforeseen circumstances, participants will be given at least 24 hours notice when possible. Alternate facilities will be within a reasonable travel distance from the original location.
PROGRAM TIMINGS
Program timings are as published and per confirmed booking communication unless otherwise notified to participants in writing. Depending on the program, timings may be tight but all are set to meet minimum required teaching times per Provincial or Federal Regulations and Canadian Red Cross (CRC) training standards.
Programs have no flexibility to allow for personal appointments, dealing with repeated ‘work calls’, etc. Participants should plan for this with regards to other obligations, cover at work, childcare requirements, etc and expect to start and finish at the stated times with a full commitment to the whole program. They should also remain flexible in case of over-run due to unforeseen circumstances – i.e. COVID-19 precautions, inclement weather, emergencies, etc.
PUNCTUALITY
Participants are requested to plan their travel to arrive safely and in plenty of time to commence the course at the scheduled time (arrival 10-15 minutes ahead is recommended) – planning around forecast weather for driveway clearing, travel, etc. If travelling by public transport, please allow time to walk from your drop off point (the closest Metrobus Stop to the Relyon Nutec building is approximately 500m away on Topsail Road). Anyone who knows they will be late should contact the instructor(s) as soon as possible prior to start time.
Depending on the day and time of the course, the facility may be locked for security reasons at the scheduled start time and in this instance the instructor a.) may not be aware of latecomers outside and b.) will not interrupt training already underway for others in order to unlock the building for latecomers.
INCLEMENT WEATHER
Programs may be delayed/postponed by NL First Aid due to Inclement Weather. In such circumstances the NL First Aid website www.nlfirstaid.com will be updated to show details. If a program is ALREADY underway, new arrangements will be discussed with participants before dispersal. Programs with a delayed start due to inclement weather may run past the scheduled end time. Efforts will be made to reduce the impact of revised timings by condensing breaks, etc. but participants should be prepared for this eventuality and expect to finish later. If a program has already commenced with one or more participants and others do not arrive, only verifiable weather and/or road conditions adversely affecting travel from the participant’s location will be accepted as reasons for rescheduling without penalty and only if contact is made with the instructor prior to course commencement. School snow days, uncleared driveways, etc will not be accepted as eligibility for rescheduling.
CERTIFICATION
Certifications for successful participants are issued electronically and sent to the email address provided by them. Normal certification period for CRC First Aid & CPR programs is three years unless required more frequently for specific levels. Attendance of a program does not guarantee certification - participants must attend and take part in 100% of the program, successfully demonstrate all required skills and complete a closed book, multiple choice knowledge evaluation with a minimum mark of 75%.
Unsuccessful candidates will be offered a Letter of Participation and options to rebook a program or complete specific elements will be discussed. Refund or Rescheduling without penalty will not be offered.
RESPECTFUL TRAINING ENVIRONMENT
NL First Aid provides a respectful training environment where everyone is treated equally and fairly regardless of race, ethnicity, gender, age, etc. All participants are expected to respect this policy at all times and refrain from foul language, inappropriate humour, etc. We consider Cell Phone Etiquette to be a respectful practice and in consideration of others on the program, participants will be requested to mute their cellphones, keep them off desks and limit use to breaks*. Participants not following our Respectful Training Environment policy, will be politely asked to leave the program without refund.
*Participants who may need to take a call due to an emergency – i.e. family illness – should inform the instructor(s) prior to course commencement to allow concessions to be made where appropriate.
LANGUAGE AND SPECIFIC EDUCATIONAL NEEDS
Programs offered by NL First Aid are delivered in English, using English course materials and written evaluations unless booked specifically for private groups in French.
Participants who may have difficulty understanding for any reason (hearing, reading, writing, English Second Language, etc) should inform NL First Aid at the time of and every effort will be made to accommodate individuals – i.e. by conducting evaluations verbally. Course materials and evaluations are available in French with prior notice but instruction will still be delivered in English. Participants are welcome to bring along assistants/translators with prior notice, subject to classroom space being available or to use translation tools such as Google. Electronic Course Materials for pre-program self study can be provided in English or French. If it is not possible to accommodate a participant, alternatives will be discussed.
APPROPRIATE CLOTHING
Participants are advised to wear clothing appropriate to kneeling and lying on the floor and to the physical activity required in the courses. Pants rather than skirts or dresses are recommended. Additionally, anyone wearing clothing with logos, slogans, etc. that are or may be offensive to any individual or group will be politely asked to cover them up or leave the program without refund.
PRE-COURSE STUDY
Pre-Course Study is not a requirement but digital materials can be provided on request to customers after booking to allow participants to review program content ahead of time if they wish.
BREAKS
Programs include breaks of approximately 15 minutes mid-morning and mid-afternoon and approximately 30 minutes at lunchtime, beginning at appropriate times determined by the instructor(s).
REFRESHMENTS / MEALS
Refreshments and meals are not provided and are the responsibility of participants.
INTOXICATION / IMPAIRMENT
Any participant suspected of being intoxicated or impaired due to alcohol or other substances will be excluded from the program.
EQUIPMENT AND ROLE PLAY
Depending on the level of training, courses use items such as CPR mannequins and simple wound care items through to full-size mannequins, oxygen delivery systems, stretchers and spine-boards. Additionally, make-up, authentic looking artificial wounds and fake blood may be used. In addition to a requirement to act as a responder, participants are expected to take part in role-play as injured or ill persons. It is recommended that participants wear clothing appropriate to the role-play (NL First aid accepts no responsibility for damage, dirtying or staining of clothing).
